Grateful for the enlightening panel discussion alongside the Honorable Mr. Justice Tassaduq Hussain Jillani and Umar Azmeh. This insightful webinar 'Place of International Commercial Courts in a National Disputes System' provided an in-depth dissection of the role of international commercial courts and their placement in Pakistan's unique legal topography. I highlighted the potential benefits of collaborations and the role of CIArb Pakistan Branch in fostering such partnerships and shared insights into leveraging successful international commercial court models for Pakistan's legal landscape. I further discussed the opportunities and challenges in having both ICC and international arbitration centers coexist in Pakistan. This discussion was moderated by Kashaf Fatima. A brief overview of how the discussion went for those who were not able to join: Honorable Mr. Justice Tassaduq Hussain Jillani enriched the discussion with his following contribution: - He addressed questions on harmonizing international commercial court practices with existing legal frameworks in Pakistan. - He proposed ideas for crafting a conducive environment for an international commercial court in Pakistan. -He shared the general consensus in Pakistan for the incorporation of international commercial courts and a futuristic perspective of incorporating such. - He discussed the potential challenges in implementing international commercial courts and proposing solutions and insights on concurrent development in legal infrastructure for international commercial courts.   Umar Azmeh shared insights from the frontlines, offering a global-best practice perspective from the QICDRC’s ‘one-stop-shop’ forum for transnational dispute resolution.  Specifically: - He elaborated on QICDRC's model as a one-stop-shop for international commercial disputes and its integration of court and alternative dispute resolution services. - He navigated us through the mechanisms undertaken to ensure fair and impartial dispute resolution in an international forum. - He shared the role of technology in enhancing the efficiency and accessibility of both court and ADR services at QICDRC. - He discussed a summary of 6 unique points that allow QICDRC to stand out as an international court and how other jurisdictions may follow suit. This joint webinar organized by the CIArb Pakistan Branch and Qatar International Court and Dispute Resolution Centre was a testament to our shared goals. Former Chief Justice of India (CJI) NV Ramana has been appointed as a member of the prestigious International Mediator Panel of Singapore International Mediation Centre (SIMC). A letter of appointment was presented to him by George Lim, Chairman of SIMC, on August 29 in Singapore. Justice Ramana took part in the ‘Singapore Convention Week’, the annual convention organised by Singapore’s Ministry of Law, United Nations Commission on International Trade Law (UNCITRAL) and over 20 partner organisations. Justice Ramana also met the representatives of SIMC and of four top Indian Multi National Companies (MNCs). During his tenure as the CJI, Justice Ramana spoke about the importance of mediation in removing the burden in the justice delivery system. Justice Ramana spoke about how mediation should be made mandatory as a first step for dispute resolution and also suggested that a law be framed in this regard. Even after his tenure as Supreme Court Judge ended, Justice Ramana this year spoke about how a shift in the public’s mindset to opt for mediation is one of the biggest challenges in this field. . . However, this concept remains undefined and broad, leading to uncertainties, particularly in light of recent Vietnamese court decisions. 🔎 In 2020, the People’s Court of Ho Chi Minh City ("HCMC Court") set aside a Vietnam-seated arbitral award based on the grounds that a power of attorney issued by a foreign company was not legalized by the consulate of Vietnam in Cambodia. In big news for companies doing business internationally, the UK has recently announced that it will become a signatory to the Signapore Convention on Mediation. Find out what this means for your company below. The Singapore Convention on Mediation is an international agreement to which some 55 of the largest economies in the world are parties. It provides a framework for the enforcement of settlement agreements arising from mediation between parties with their places of business in different states. In other words, where a dispute between your company and a company operating in a different country is settled by mediation, that settlement agreement can be enforced in any country that has signed up to the Singapore Convention on Mediation, without the need to commence full proceedings in that jurisdiction. The UK becoming a signatory is significant for a number of reasons. (a) It raises the profile of mediation in the UK generally; (b) It increases the credibility of UK seated mediations, and of UK mediators themselves; (c) It helps to maintain the UK's position as a favoured forum for the resolution of international disputes.
