Supreme Court of Singapore and Supreme People’s Court of The People’s Republic of China sign MOU on Cooperation on the management of international commercial disputes in the context of BRI through a Litigation-Mediation-Litigation framework The Singapore International Commercial Court is proud to announce that on 1 April 2023, the Supreme Court of Singapore signed a Memorandum of Understanding (MOU) on Cooperation on the management of international commercial disputes in the context of the Belt and Road Initiative (BRI) through a Litigation-Mediation-Litigation (LML) framework with the Supreme People’s Court of the People’s Republic of China (PRC) in Beijing. The signing was witnessed by Prime Minister Lee Hsien Loong of Singapore and Premier Li Qiang of the People’s Republic of China. PM Lee was on a high-level visit to China. In view of the increasing complexity of disputes relating to international trade and commerce, the two Courts agreed, through this MOU, to strengthen cooperation on the management of international commercial disputes arising from BRI projects. This is in recognition of the flexible, creative and efficient ways that mediation may offer to resolve such disputes, which not only save the parties time and costs, but also preserve their business relationships and provide them with greater control over the outcome of the dispute resolution process. Under the MOU, each Court will develop and implement the LML framework to manage BRI disputes, facilitated by a domestic or foreign mediation expert, and domestic, foreign or international mediation institution. Both Courts agree to mutually share information on its LML framework and other dispute management practices, including information on the procedural rules, case management protocols and practices, and enforcement processes relating to the Singapore International Commercial Court and the China International Commercial Court. The two judiciaries also agree to promote the LML framework by recommending the appropriate adoption of the LML Model Clauses. The signing of the MOU reaffirms the close working relationship between both Courts and demonstrates the strong commitment to enhance access to justice in our respective jurisdictions. A groundbreaking treaty between Bahrain and Singapore has led to the establishment of the Bahrain International Commercial Court (BICC), modeled after the Singapore International Commercial Court (SICC) The treaty allows appeals from the BICC to a designated body of judges from both Bahrain and Singapore, as well as to judges of the SICC. This initiative is part of Bahrain's efforts to enhance its dispute resolution capabilities and establish itself as an international hub for commercial disputes. The BICC, set to launch later this year, will hear international commercial disputes and arbitration-related matters in both English and Arabic. The treaty has been hailed as a transformative step towards strengthening the rule of law and promoting access to justice on an international level. It is also seen as a significant milestone in the collaboration between the Singaporean and Bahraini judiciaries. The treaty is expected to benefit both countries and is seen as a positive development for the Gulf region. This unprecedented and innovative initiative marks the start of a significant journey for Bahrain as it seeks to become a neutral seat for the resolution of disputes.
