Following a recent ruling by the Cairo Court of Appeal regarding the enforcement of arbitration awards in Egypt, two members of our Egypt disputes team, Partner Sherif Maher and Senior Associate Mohamed El Mahdy, have shared their insights into the impact of this judgement in a new article, ‘The Requirement to Formally Serve Your Award in Egypt - A Trigger to the Time Limit to Challenge the Award'. On 27th October I had the pleasure of attending the Chartered Institute of Arbitrators Kenya Branch's 2nd Mediation Conference. The discussions facilitated by seasoned Mediators piqued my interest in this mechanism and prompted me to share these takeaways: °Conflict management is highly culture specific. The Grassroot outreach of mediation amongst our communities starts with defining mediation in local dialects. When mediation is broken down to a familiar digestable concept, the communities become receptive to it. ° The growth of Mediation largely depends on changing our mindset of the process as an 'Appropriate' Dispute Resolution mechanisms as opposed to an 'Alternative' mechanism in so far as it is legally applicable. °There are ample rules, ethical standards and best practices codified to guide the practice of mediation in Kenya and across borders such as the Singapore Convention, UNCITRAL Mediation Rules, CiArb Code of Conduct for Arbitrators and Mediators, Kigali International Arbitration Centre Mediation Rules et al. ° Public and Private institutions are using mediation to resolve conflict effectively and conclusively. The Ethics and Anti-Corruption Commission (EACC), Kenya Revenue Authority (KRA) and Kenya Electric Generating Company (KenGen) was represented at the Conference and confirmed that mediation has been used to successfully resolve disputes within their institutions. Such disputes are civil in nature and Not Criminal. °Finally, agreements arrived at through private or court annexed mediation need to be registered in Court for enforceability as an order of the court. On 19 and 20 December, the HCCH and The Cooperation Council for the Arab States of the Gulf (GCC) co-organised the seminar “HCCH Transnational Litigation and Apostille Conventions in the GCC”, open to representatives of GCC Member States. The seminar is the first initiative organised under the framework of the Memorandum of Understanding signed by the HCCH and the GCC in 2022. This seminar, held in Riyadh, Kingdom of Saudi Arabia, was designed to promote awareness of the HCCH and to foster a deeper understanding throughout the Gulf region of the operation and benefits of its Conventions and instruments, focusing on the 1961 Apostille, 1965 Service, 1970 Evidence, 2005 Choice of Court, and 2019 Judgments Conventions. Dr Christophe Bernasconi, Secretary General of the HCCH, and Ms Melissa Ford, Secretary of the Transnational Litigation and Apostille Division, represented the HCCH at this seminar. During the visit to Saudi Arabia, Dr Bernasconi met with H.E. Dr Hala bint Mazyad Al-Tuwaijri, President of the Human Rights Commission, Mr Mohammed Al Nasser, Director General of the Legal Department of the Ministry of Foreign Affairs, and Mr Baker Alhaboob, Deputy of Regulatory and Public Policy Development, Ministry of Investment.   At present, four GCC Member States are Contracting Parties to one or more HCCH Conventions: Saudi Arabia, Oman, Bahrain, and Kuwait.
