Global momentum for mediation is gaining pace with recent developments in several major jurisdictions. In March, the UK declared it was "the right time" to become party to the Singapore Convention on Mediation ("SCM"), and signed in May. In August, India's Parliament passed the Mediation Bill, paving the way for the country's ratification of the Convention. In the same month, 42 business and legal industry associations and MNCs from a wide range of sectors, came together in Singapore to sign declarations in the strongest show of corporate support in Asia yet for international mediation. Finally, in early October, Japan acceded to the SCM and it will enter into force on 1 April 2024.


The first panel discussion at SIMC Seminar@ Seoul ADR Festival 2023: PRACTICAL INSIGHTS INTO MEDIATING MEGA TECH DISPUTES & RISING TRENDS IN ASIA will take stock of these developments and how they're shaping ADR into a movement for "appropriate dispute resolution".

Then we dive deep into a recent cross-border mediation in Seoul for a rare, behind-the-scenes conversation between mediator and lead counsel. They will discuss their multi-million dollar green technology case which started in arbitration and ended in mediation. Hear about the twists and turns: the difficulties in finding the right mediator, how the case almost got derailed, what worked (and didn't), and what it took to bring the case to resolution in two days.


As more businesses achieve such successful outcomes, proposing mediation indicates to the other party that one values the business relationship. A skilled mediation advocate will balance outcomes and expectations, so that the end result will be expeditious, cost-effective and as harmonious as possible. Learn the ways this can be done.
